Disturbing the peace is a violation of Penal Code Section 415.  Disturbing the peace can occur in many ways.  It can be the result of a fight in a public place; it can occur by a loud or unreasonable noise or playing your music too loud; it can also be one who uses offensive words which are likely to provoke violence.

If you are charged with disturbing the peace, the critical issue in the case   is whether the District Attorney files it as a misdemeanor and an infraction.  Once can carry probation and jail time and the other can be a simple fine.
