Embezzlement is a violation of Penal Code Section 503 and can be filed as a felony or a misdemeanor. Embezzlement is defined as the fraudulent appropriation of property by a person who has been entrusted.
In order to find someone guilty of embezzlement, the defendant must have a relationship of trust with the victim. In addition, there must be intent to deprive the victim or owner of the property. If the suspect intends sometimes later to return the property, this is not a defence.
There is a defense for embezzlement if the property was appropriated openly and under a claim of good faith.
