Auto theft is a violation of Vehicle Code Section 10851. Vehicle theft under Vehicle Code Section 10851 is a “wobbler”. It can be charged as either a felony or misdemeanor.

Grand theft auto occurs when a person intends to permanently deprive the owner of a vehicle from possession of their vehicle.

The elements of this charge are as follows:

1. The person takes or drives a vehicle that is not his own;
   
2. The vehicle is taken without the consent of the owner;
   
3. The person has the intent to either permanently or temporarily deprive the owner of his possession of the vehicle.
